One TCPA violation or CMS infraction can cost your license.
One ignored DNC request can cost the agency six figures in fines. Compliance isn't a box to check — it's how you stay in business. If you're ever unsure, stop and ask before you dial.

TCPA

Federal
  • Only dial leads with documented prior express written consent. No consent, no call — ever.
  • Calls only between 8:00 AM and 9:00 PM in the prospect's local time zone. We enforce 8:00 AM – 8:30 PM for safety margin.
  • If a prospect says "take me off your list," "remove me," "stop calling" — the call ends immediately. Log the DNC request and add them to the internal suppression list.
  • Recording disclosure is required before any substantive conversation in most states. AVA handles this on inbound; you handle it on outbound manually.
  • The digital business card cannot be texted BEFORE a call — only DURING the call, within the first 60 seconds, after verbal permission.

CMS / Medicare

Medicare Only
  • Scope of Appointment (SOA) is required before discussing specific MAPD or Medicare Supplement plan benefits. No exceptions.
  • Never use prohibited marketing terms: "free," "limited time," "government approved," "confidential," or any language implying CMS endorsement.
  • All Medicare marketing calls must be recorded and retained for 10 years per CMS requirement.
  • AHIP certification renewed annually — required before you can submit MAPD applications.
  • Never mislead on plan comparisons, benefits, or provider networks. If you don't know an answer, say so and research it.

DNC

Federal + State
  • National DNC list is scrubbed automatically via the dialer. State DNC lists for TX, VA, NC, SC, NV are also scrubbed.
  • Internal DNC (any prospect who asked to be removed) is honored permanently across all PIC agents.
  • A prospect who fills out a lead form has consented to that campaign — but only that campaign. Don't assume the consent transfers.
  • When in doubt, do not dial. The cost of missing one call is zero. The cost of a DNC violation is significant.

State Requirements

VA · NC · SC · TX · NV
  • You must be actively licensed in the state where the prospect resides. Not where they're located physically — where they live.
  • State-specific disclosures are required in some states (Texas Medicaid rules, NC Medicare requirements, etc.). When in doubt, escalate before pitching.
  • NPN must be current. Appointment with each carrier in each state must be active before you can submit business.
  • CE requirements vary by state. Track your CE deadlines — expiration costs you your book.
